The Honorable Roy Cooper
North Carolina Attorney General
9001 Mail Service Center
Raleigh, NC 27699-9001

Dear Attorney General Cooper:

In the wake of President Obama’s new health care law, we strongly urge you to join other Attorneys General from around the country in challenging its constitutionality.

The Constitution gives the Federal Government the authority to regulate interstate commerce, but this legislation goes far beyond that power.  An individual is not engaged in interstate commerce if he decides not to purchase insurance, and compelling him to make such a purchase is beyond the bounds of the interstate commerce clause.

Florida, Texas, South Carolina, Pennsylvania, North Dakota, South Dakota, Alabama, Nebraska, Utah, Oklahoma, Virginia, Missouri, Idaho, and Washington are all challenging the constitutionality of this unprecedented new mandate on the American people.  The state of North Carolina should be a part of that effort.

This new law will kill jobs.  It hurts small businesses, hurts families and will drive up the cost of health care in this country.  It is an imposition on North Carolinians’ freedom and will do real harm to the people of our state.

We urge you to stand up for the people of North Carolina and challenge this new law in court.  Thank you in advance for your consideration.

                                                            Sincerely,

Patrick McHenry, M.C.                                          Howard Coble, M.C.
